Welcome to Nanopost. These Terms of Service ("Terms") govern your access to and use of the Nanopost platform, website, and services (collectively, the "Service") provided at nanopost.xyz. By accessing or using the Service, you agree to be bound by these Terms.
By creating an account or using Nanopost, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service. You must be at least 18 years old, or the age of majority in your jurisdiction, to use Nanopost.
Nanopost is an AI-powered social media platform that helps users monitor competitor content, generate on-brand content using artificial intelligence, and publish that content to connected social media accounts (currently Instagram Business and Creator accounts). All published content requires explicit user approval before going live.
To use Nanopost's publishing features, you must connect a social media account (e.g., Instagram Business). By connecting an account, you:

Your Content. You retain ownership of all content you upload to or generate through Nanopost (including brand assets, books, captions, and AI-generated outputs published under your accounts). You grant Nanopost a limited, non-exclusive license to process, store, and transmit your content solely to operate the Service on your behalf.
Competitor Data. Nanopost retrieves publicly available competitor posts for analysis. You are responsible for ensuring your use of derived insights complies with applicable copyright, trademark, and platform terms. AI-generated content is intended to be inspired by but materially distinct from source material.
Our Service. All Nanopost software, branding, and proprietary technology are owned by us. These Terms do not grant you any right to our trademarks or service marks.
Nanopost uses third-party AI models (including OpenAI's GPT and image generation models, and xAI's Grok) to produce content. AI outputs may contain errors, inaccuracies, or unintended material. You are solely responsible for reviewing all generated content before publishing. Nanopost provides a mandatory human-in-the-loop review step — content is never auto-published without your approval.
Nanopost may charge subscription fees or usage-based fees for access to the Service. Pricing is displayed in-app. AI operations (text generation, image generation) incur third-party API costs that may be passed through or included in your plan. You are responsible for fees incurred under your account. Refunds are issued at our discretion.
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party service outages (Meta API, OpenAI API, etc.), or unforeseen technical issues may temporarily affect functionality. We are not liable for losses resulting from such interruptions.
You may terminate your account at any time by contacting hi@nanopost.xyz. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or pose a security risk. Upon termination, your data will be deleted in accordance with our Privacy Policy.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. Reliance on AI-generated content is at your own risk.
To the maximum extent permitted by law, Nanopost and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
You agree to indemnify and hold Nanopost harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which Nanopost operates, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of that jurisdiction.
